Buying & leasing a commercial property.

Commercial property law is complex and varies from residential property.  Transactions often involve significant sums of money, so the stakes are high and there is a more significant level of risk to your business if the legal process isn’t watertight.

Our team can support you with every step of purchasing or leasing a commercial property, covering areas such as new leases, lease transfers, lease renewals, and rent deposits.

Your commercial property team.

Whether you want to grow your commercial property portfolio, or you’re just getting started with your first commercial property purchase, you need to build a team of people you can rely on. At Holden Smith, we’ll work with you to ensure you access the very best support and advice at every stage of your journey.

Our team have become trusted commercial property advisors to hundreds of clients including accountants, banks, commercial landlords, developers, business tenants, pension funds, agents and construction companies - helping them to buy, let, develop, manage, and sell commercial property.

Why do I need a commercial property solicitor?

Instructing solicitors when leasing or buying commercial property makes sound business practice.

A solicitor can advise on matters you may not have considered, such as whether you will be able to exercise the break clause in your lease, whether the transaction needs to be registered at the Land Registry or Stamp Duty paid, or the possible application of the Landlord and Tenant Act 1954.

If you are buying property with the benefit of mortgage funding, your lender will usually require solicitors to be instructed, and for you to bear the cost of this.

  • I would really recommend Peter Foxall at Holden Smith. I recently sold a commercial property with a sitting tenant and I had professional, personal contact with Peter the whole way through. He kept me up to date at every stage and responded quickly to my queries. I will continue to use Peter for all my residential and commercial property work.
