What is a law firm intervention?

All law firms across England and Wales are regulated by the Solicitors Regulation Authority (SRA). It is their responsibility to ensure that law firms are correctly managed and adhere to their seven core principles. The seven core principles are:

  1. Uphold the rule of law and the proper administration of justice.

  2. Uphold public trust and confidence in the solicitors' profession and in legal services.

  3. Act with independence.

  4. Act with honesty.

  5. Act with integrity.

  6. Encourage equality, diversity, and inclusion.

  7. Act in the best interests of each client.

If the SRA has evidence that a law firm has not been acting in accordance with the core principles or the law, it can intervene by closing the law firm and preventing it from acting for its clients. This is a very serious process, and the SRA will only intervene if it feels that there are risks to the public or damage to the reputational integrity of the legal profession.

What happens when a law firm is intervened?

When the SRA intervenes in a law firm, it will appoint “intervention agents” to take over the firm and review all documents and papers relating to the firm’s clients. This includes any financial records and files. This is a completely safe process and will be carried out with the utmost care, privacy, and compliance with the law.

Any money held by the firm, the SRA, and their appointed intervention agents will be returned to the person or company it belongs to, provided they can trace its origin.

How does this affect you?

If you have a case with a law firm that has been intervened. Then you will be contacted by the SRA to explain why they have intervened the law firm.

The SRA will also contact you, advising you to instruct new solicitors to represent your case should you wish to continue it. They will also direct you to their “Find a Solicitor” directory on their website.

If your case has already completed by the time the firm has been intervened, you may be contacted for compliance reasons just to let you know that any information that the firm holds about you is being handled by someone else.
